Overview

This website is operated by SBHY Pty Ltd (ABN: 45681875016) trading as SBHY Alpine (‘SBHY’, ‘we’, ‘us’, ‘our’). Throughout the site, the terms ‘SBHY’ and ‘SBHY Alpine’ refer to the same entity. By accessing our website or purchasing from us, you agree to these Terms & Conditions. 

These Terms apply to all users worldwide, including browsers, vendors, customers, and content contributors. 

1. Pricing & Accuracy 

All prices are in AUD and inclusive of GST unless otherwise stated. Prices may fluctuate due to supplier changes, foreign exchange, or promotional activity. While we strive for accuracy, errors may occur. If an error affects your order, we’ll notify you and give the option to reconfirm or cancel. 

2. Acceptance of Terms 

By using this site, you agree to be bound by these Terms. If you do not agree, you may not access our website or services. 

3. Definitions

  • Customer: the individual or entity purchasing SBHY products.
  • Website: www.sbhyalpine.com (and related domains).
  • Terms: this document and related SBHY policies. 

4. Online Store Terms 

You must be at least 18 years old (or have parental consent) to make a purchase. Products may not be used for unlawful purposes. 

5. Order Confirmation 

Once an order is placed, you will receive an email confirmation. Please check junk/spam folders if it does not arrive. 

6. Payment Options 

We accept:

  • Visa, Mastercard, Amex
  • Apple Pay, Google Pay, PayPal
  • Shop Pay, Afterpay 

(All processed via PCI-compliant providers; SBHY does not store payment details.) 

7. Shipping & Delivery 

Domestic orders are shipped via Australia Post/Courier.

  • International shipping available; duties/taxes are the customer’s responsibility unless otherwise stated.
  • Estimated delivery times provided at checkout; delays outside our control are not our responsibility. 

8. Discounts & Campaign Codes 

Promo codes must be applied at checkout and cannot be applied retrospectively. 

9. Ordering, Modifications & Cancellations 

  • Orders may be modified/cancelled within 24 hours if not yet dispatched.
  • SBHY reserves the right to cancel suspected fraudulent or bulk/resale orders. 

10. Taxes & Import Duties 

For AU customers: GST is included. 
For international customers: you are responsible for duties, taxes, and customs fees. 

11. Returns & Refunds 

  • Returns accepted within 30 days of receipt for unworn, unwashed items with tags attached.
  • Refunds issued within 14 business days of approval.
  • Faulty items covered under Australian Consumer Law. 

12. Customer Accounts 

If you create an account, you are responsible for maintaining confidentiality of your login details. 

13. Gift Cards & Store Credit 

  • Non-transferable, valid for 3 years (in line with AU law).
  • Not refundable for lost or stolen items. 

14. Warranty 

SBHY gear is covered by statutory guarantees under Australian Consumer Law. For warranty claims, contact hello@sbhyalpine.com 

15. Privacy & Data Protection 

We comply with the Privacy Act 1988 (Cth) and Australian Privacy Principles. See our Privacy Policy. 

16. User Content 

SBHY may feature user-generated content (e.g., tagged photos). By tagging us, you grant permission for us to use this content on our platforms. 

17. Intellectual Property 

All website content, including text, images, logos, and designs, is the property of SBHY Pty Ltd or its licensors. 

The names “SBHY” and “Should’ve Been Here Yesterday” are trademarks owned by SBHY Pty Ltd. Unauthorised use, reproduction, or distribution of these trademarks or any SBHY branding is strictly prohibited and may result in legal action. 

Unauthorised use is prohibited. 

18. Colour Accuracy 

We aim to display colours accurately but cannot guarantee perfect matches due to screen variations. 

19. Limitation of Liability 

To the fullest extent permitted by law, SBHY is not liable for indirect, incidental, or consequential damages. 

20. Force Majeure 

We are not liable for delays caused by events beyond our control (natural disasters, supply chain issues, etc.). 

21. Accuracy of Billing Information 

You agree to provide accurate and up-to-date information. 

22. Governing Law 

These Terms are governed by the laws of New South Wales, Australia. 

23. Third-Party Services 

We may use third parties for payment/shipping. We are not liable for their errors but will assist in resolving issues.

25. Dispute Resolution 

Disputes will be handled under Australian law. Customers have rights under the Australian Consumer Law and may contact the ACCC or NSW Fair Trading. 

26. Updates to Terms 

SBHY may revise these Terms at any time. The latest version will always be posted here.
